Everjaar

Terms of Service

Last updated 10 October 2026

These terms govern your use of Everjaar, the family calendar at everjaar.com. By requesting a sign-in link, creating or joining a family space, or otherwise using Everjaar you agree to them. Please read them together with our Privacy Policy, which explains how we handle personal data.

Who we are

Everjaar is operated by a corporation incorporated in the Province of Ontario, Canada, that does business under the name Everjaar. You can reach us at hallo@everjaar.com. In these terms “Everjaar”, “we” and “us” mean that corporation, and “you” means the person using the service.

What Everjaar is

Everjaar is a private family tree that keeps a birthday calendar: birthdays, wedding anniversaries, remembrance days and milestones of one family, with reminders by email, an in-app inbox, a calendar feed and a printable calendar. Each family keeps its own family space. Everjaar is meant for the private use of a family and its members; it is not a public genealogy site and trees are never public.

Your account

  • You must be at least 16 years old to have an account.
  • You sign in with a one-time link that we email you; there is no password. Keep your mailbox secure and tell us at once if you think someone else has used your account.
  • You are responsible for what happens under your account. Give us a working email address and keep it up to date, because that is how we reach you.
  • One account is for one person. Do not share it.

Family spaces and roles

A family space is created on request and approved by Everjaar. The person who creates it is its owner. Owners and admins maintain the tree, decide who is invited and in which role, and approve requests to join. The owner is also the person who pays for the family space and who can hand it over or retire it.

Owners and admins are responsible for the content of their family space and for the people they let in. Members use the space within the role they were given.

Your content and other people’s data

What you enter stays yours. You give Everjaar permission to store, show, process and send it, only as far as needed to provide the service to you and your family. We claim no rights to your family history.

A family tree is full of information about other people, including relatives who have never heard of Everjaar. When you enter data about someone else you confirm that:

  • you may do so, for the private use of your family, and you have told or will tell the person when that is reasonably possible, for example by inviting them;
  • you respect their choices: what they consent to share, what they mark “only me”, and a request to correct or remove their data;
  • you do not enter data to harass, expose, defame or harm anyone, and you do not add photos, documents or notes you have no right to share;
  • you keep the sensitive details of others (health, religion, sexuality, criminal matters) out of notes unless the person themselves asks for it.

Everjaar helps you honour these rules with per-person consent, visibility settings and a review queue, but the responsibility for what goes into a family space lies with the people who enter it. We may remove content or suspend a family space when these rules are broken.

Acceptable use

You agree not to:

  • use Everjaar for anything unlawful, or to store content that is unlawful, hateful or harassing;
  • try to reach data of a family you are not a member of, or data a person has not shared with you;
  • scrape, crawl or automatically read Everjaar, other than through your own calendar feed;
  • interfere with the security or operation of the service, or probe it for weaknesses without our written agreement;
  • send invitations or join requests to people who do not want them, or use Everjaar to send spam;
  • resell Everjaar, or work around the limits of a plan or trial.

Plans, trial and payment

  • Everjaar costs one flat amount per family space per year, whatever the size of the family. The plans and what they include are shown in the app; the price in your currency, including applicable taxes, is shown before you pay.
  • A new family space starts with a free trial without a payment method. Everjaar may also grant free periods and discount codes; such grants are a courtesy and can be limited to one per family.
  • Payments are processed by Stripe, which acts as the seller of record for Everjaar subscriptions. Stripe’s own terms apply to the payment itself. Everjaar never sees your card details.
  • A subscription renews automatically each year at the price then in effect, unless you cancel before the renewal date. We remind the owner by email 30 and 7 days before renewal. Cancelling on the billing page stops the next renewal; the family space stays on its plan until the end of the paid period.
  • If you cancel within 14 days of your first payment, we refund it in full on request. After that, a period that has started is not refunded unless the law of your country requires it. Consumers in the European Union keep their statutory rights.
  • We may change our prices. A price change applies to you only from your next renewal, and we tell the owner at least 30 days before.
  • A gift is a one-time payment for one year of the Familie plan, delivered as a code. It does not renew, it is valid for one year from the purchase and can be redeemed once, by one family space. Whoever redeems it gets the year from that day, added to any time the family already has. A gift code can be refunded in full on request while it has not been redeemed.

When a subscription ends

When a trial or subscription ends without renewal, the family space keeps working for a grace period of 14 days and then becomes read-only: everyone can still look, nobody can change anything, and no reminder emails are sent. Nothing is deleted for non-payment. The owner can export the whole family space at any time, and paying again reopens it.

Availability and changes to the service

We do our best to keep Everjaar available and to deliver reminders on time, but we cannot promise uninterrupted service. We may change, add or remove features. When we remove something you rely on, we tell you in advance where we reasonably can. Should we ever stop Everjaar altogether, we give you at least 90 days’ notice and the time to export your family space.

Ending the agreement

You can stop at any time: leave a family space, retire a family space you own, or delete your account under Settings. What happens to your data is described in the Privacy Policy.

We may suspend or end your access when you break these terms, when the law requires it, or when your use puts other users or the service at risk. We tell you why and, unless the matter is urgent, give you the chance to put it right first. An owner who is suspended can still export the family space.

Everjaar’s own rights

The Everjaar software, design, name and logo belong to Everjaar and are protected by copyright and trademark law. You may use them only as part of using the service. This does not limit your rights to your own content.

What we cannot guarantee

Everjaar is provided as it is. The calendar is only as accurate as the data your family enters; we do not check the correctness of names, dates or relationships. Everjaar helps you remember, but a missed reminder, an email that lands in a spam folder or a service interruption can happen, and Everjaar is not a substitute for your own records. To the extent the law allows, we give no warranties beyond what these terms say.

Liability

To the extent permitted by law, Everjaar’s total liability for all claims arising from the service in any twelve-month period is limited to the amount your family space paid us in those twelve months, and we are not liable for indirect losses such as missed celebrations, lost profit or loss of data that you could have exported. Nothing in these terms excludes or limits liability that cannot be excluded by law, such as liability for intent or gross negligence, or your rights as a consumer under mandatory law.

You are responsible towards others for content you enter in breach of these terms.

Applicable law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you are a consumer living in the European Union, the mandatory consumer protection rules of your own country still apply to you, and you may bring a dispute before the courts of your own country.

If something goes wrong, please talk to us first at hallo@everjaar.com; most problems are solved that way.

Changes to these terms

We may update these terms. The date at the top shows the current version. For material changes we notify you by email or in the app at least 30 days before they take effect. If you do not agree with a change, you can stop using Everjaar and delete your account before it takes effect; continuing to use Everjaar after that date means you accept the new terms.
